1. General & Acceptance of Terms
By accessing this website, placing an order, or making payment to BY CHEF SARA ("we", "us", "our", or "the brand"), you confirm that you are at least 18 years of age (or have parental/guardian consent) and agree to be bound by these Terms & Conditions in full. If you do not agree with any part of these Terms, please do not proceed with your order.
2. Nature of Artisanal Food Products
All products offered by BY CHEF SARA are handcrafted food items prepared fresh in small batches without artificial preservatives. Because items are artisanal: natural variations in color, texture, shape, garnish, and appearance between batches are customary and expected. Variations that do not compromise food safety, taste, or core product integrity do not constitute a defect or failure of specification.
3. All Sales Final (No Returns & No Refunds)
In compliance with international food hygiene regulations and UAE consumer protection practices for perishable goods: all food sales are final. We do not accept returns, cancellations, exchanges, or refund requests once an order has been prepared or dispatched. Refunds or exchanges are not provided for personal taste preferences, change of mind, partial consumption, recipient unavailability, or delivery delays caused by external courier factors beyond our reasonable control.
4. Transit Damage & Verification Policy
We package every item with care to ensure it arrives in optimal condition. In the rare event an item is visibly damaged, cracked, or leaking upon arrival: Reporting Window: You must report the issue within two (2) hours of confirmed delivery by contacting our customer care team via WhatsApp or email at [email protected]. Required Evidence: Clear, high-resolution photographs and/or video of the unopened product, outer packaging, shipping label, and the specific damage or leak must be provided. Remedy: Once verified as damage occurring prior to delivery acceptance, BY CHEF SARA will, at our election, provide an immediate priority replacement or a refund/store credit for the damaged item.
5. Discretionary Review for Sealed Products
Unopened, shelf-stable items in their original, tamper-evident packaging may be submitted for review within 48 hours of delivery. Any replacement, exchange, or store credit issued under this clause is evaluated on a strict case-by-case basis at our sole discretion.
6. Cash on Delivery (COD) & Security Deposits
Orders placed under Cash on Delivery (COD) may require a non-refundable security deposit at checkout, as disclosed prior to payment confirmation. This deposit covers direct preparation, packaging, and perishable ingredients dedicated to your order. Forfeiture: If a customer arbitrarily rejects delivery, cancels after kitchen preparation has commenced, or fails to pay the outstanding balance to the courier upon arrival, the security deposit is forfeited in full.
7. Order Acceptance, Modifications & Cancellations by Us
Confirmation receipts generated at checkout do not constitute a binding acceptance of an order. We reserve the right to limit, decline, or cancel any order prior to dispatch due to ingredient unavailability, pricing or listing errors, delivery zone restrictions, or suspected fraudulent activity.
8. Pricing, Currency & Availability
All prices are displayed in UAE Dirhams (AED) and include Value Added Tax (VAT) where applicable by UAE law. Prices, active promotions, and product availability are subject to change without prior notice.
9. Delivery & Recipient Availability
Delivery timeframes provided at checkout are estimates and cannot be strictly guaranteed due to traffic, weather, or third-party courier dispatch conditions. The customer is solely responsible for providing complete and accurate delivery details.
10. Storage & Product Handling After Delivery
Once delivered, full legal responsibility for correct storage, refrigeration, and temperature control rests entirely with the customer. Perishable items must be refrigerated or frozen immediately in accordance with product label instructions.
11. Allergen Declaration & Kitchen Notice
Our kitchen prepares items that contain or may come into contact with common allergens, including tree nuts, peanuts, dairy, eggs, soy, sesame, and gluten. Complete ingredient declarations are available upon request and listed on product pages.
12. Promotional Offers & Discount Codes
Promo codes are valid only within their stated promotional period, may not be combined with other offers unless explicitly stated, and carry no monetary cash surrender value.
13. Catering & Large Custom Orders
Catering bookings, bespoke dessert tables, and large corporate orders require custom written confirmation and an advance deposit. Deposits for catering orders cancelled inside the non-refundable window will not be refunded.
14. Product Photography & Visual Representation
Photographs, illustrations, and digital media displayed on our website and social channels are for illustrative purposes. Subtle visual differences in finish, color tone, or packaging may occur.
15. Intellectual Property
All website content—including the brand name BY CHEF SARA, logos, culinary formulas, text, graphics, photography, and brand collateral—is the exclusive intellectual property of BY CHEF SARA and protected under UAE and international copyright laws.
16. Limitation of Liability
To the fullest extent permitted under UAE law, BY CHEF SARA’s total financial liability for any claim arising out of or related to an order shall not exceed the actual purchase price paid by the customer for that specific order.
17. Governing Law & Dispute Resolution
These Terms & Conditions are governed by and construed in accordance with the laws of the United Arab Emirates. Any dispute, claim, or controversy arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts of the United Arab Emirates.
18. Amendments & Customer Support
